Welcome to the Mediceuticals South Africa website, available at https://mediceuticals.co.za/ ("the Website"), operated by Infinity Professional Group (Pty) Ltd (registration number 2017/380225/07), trading as Mediceuticals South Africa ("we", "us", "our"). Please take a moment to read these terms and conditions ("Terms") to understand how they apply to your use of the Website and any products or services you order online. USE OF AND/OR REGISTRATION ON ANY ASPECT OF THE WEBSITE WILL CONSTITUTE YOUR AGREEMENT TO COMPLY WITH THESE TERMS. If you cannot agree to these Terms, please do not use the Website.

IMPORTANT NOTICE

Where the Consumer Protection Act, 2008 ("CPA") applies to you as a consumer, certain terms which limit your rights, make you liable, or require you to confirm facts are indicated in bold text to draw your attention to them. These clauses are important and should be read carefully.

1. General terms

Who owns this Website? The Website is owned and operated by Infinity Professional Group (Pty) Ltd, trading as Mediceuticals South Africa, Mossel Bay, South Africa (registration number 2017/380225/07).

Amended or updated terms. We may periodically update or change these Terms, with changes reflected on the Website. You should check them from time to time. If you continue to use our Website 10 days after an update or change, this will mean you accept the updated or changed Terms. If you do not accept the update or change, please do not use the Website.

Law and dispute resolution. This agreement is governed by the laws of the Republic of South Africa. Any dispute arising in relation to our agreement with you will, to the extent permitted by law, be referred to arbitration in Cape Town at a venue to be determined by us, applying the uniform rules of the High Court of South Africa. This does not prevent you from referring a dispute to the National Consumer Tribunal, the Consumer Goods and Services Ombud, or any other relevant regulator.

Use of our Website. You are welcome to browse or use our Website for your own personal, non-commercial shopping and information purposes only. No other use is permitted without our prior written consent. Unauthorised use, copying, reproduction, variation, modification or distribution of the content of this Website, uploading of unlawful or damaging information or viral software, or creating links to our Website from any other site, is strictly prohibited. You are responsible for all use of the Website by you and by anyone you allow to use or access your account. You may not impersonate or pretend to be somebody else when using the Website. You agree to use the Website only for lawful purposes. We use cookies to identify the device you use to connect to our Website (see our Cookie & Tracking Policy). We reserve the right to restrict access to the Website, or to suspend or terminate your account, if we reasonably believe you are not using the Website in compliance with these Terms.

2. Privacy and information security

We collect and process personal information (as defined in POPIA) through and in connection with the Website, as described in our Privacy Policy / POPIA Privacy Notice. Any payment card information you submit is processed via our secure payment gateway; we do not store full card numbers on our own systems. We will not disclose, sell or rent your personal information to third parties other than as described in our Privacy Policy, unless required to do so by law or with your consent.

3. Orders, pricing and payment

All prices on the Website are displayed in South African Rand (ZAR) and, unless stated otherwise, are inclusive of VAT where applicable. We take reasonable care to ensure prices and product descriptions are correct, but errors may occur; if we discover a pricing or listing error after you have placed an order, we will contact you before processing the order and you may choose to proceed at the correct price or cancel. We reserve the right to refuse or cancel any order, including where a product is unavailable, where we suspect fraud, or where a pricing error has occurred, in which case we will refund any amount already paid. Payment is processed securely through our checkout at the time of order.

4. Product availability and accuracy

All products displayed on the Website are subject to availability. Should a product not be available, we will attempt to contact you to offer an alternative or a refund. Any comments uploaded by users or invited guests are their own opinions and do not represent our views.

5. Cancellations, returns and refunds

6. Defective products and warranties

Where the CPA applies, you are entitled to return goods that are unsafe, of poor quality, or defective, within six months of delivery, for repair, replacement or refund, in accordance with section 56 of the CPA. This is in addition to, and not instead of, any manufacturer's warranty and your rights under our Returns & Refunds Policy.

7. Intellectual property

All rights, including copyright, trademark and other intellectual property rights in any logos, text, images (including product images), video, audio or other material on this Website are owned by or licensed to us or the Mediceuticals brand owner. You may view, print or store electronically a copy of information on our Website, including these Terms, solely for your personal, lawful, non-commercial use. Unauthorised use, copying, modification or distribution of any information on the Website is strictly prohibited and constitutes an unlawful infringement of our and/or our licensors' intellectual property rights.

8. Advertising and hyperlinks

External hyperlinks and third-party advertising may appear on our Website. These do not imply any relationship between us and the linked third party, or any endorsement by us. Your reliance on, or use of, any external links or third-party material is entirely at your own risk, and we will not be responsible for any loss or harm you suffer as a result.

9. Disclaimers and limitation of liability

Use of our Website is at your own risk. We cannot guarantee the Website will be uninterrupted, error-free, or free of viruses or other harmful components not introduced by us. To the extent permitted by law, we accept no liability for indirect, incidental, special or consequential loss or damage arising from your access to or use of the Website, save that nothing in these Terms limits our liability for harm caused by any product failure, defect, hazard, inadequate warning, or unsafe goods, as protected under the CPA, or for any liability that cannot lawfully be excluded or limited. Subject to the foregoing, our maximum liability arising from any breach of these Terms, negligence or otherwise (excluding gross negligence, recklessness, malicious conduct or criminal conduct) will not exceed double the monetary value of the relevant order placed via the Website, unless otherwise required by law.

10. Indemnification

You agree to reimburse us for any claims, losses, harm or liabilities we may suffer arising from your submissions, your unauthorised use of material obtained through the Website, or your breach of these Terms.

11. Registration and accounts

To register an account, you will be asked to provide certain information, which may include your name, email address, cell phone number and delivery address. Please keep your password confidential; we accept no liability for damages arising from misuse of your password where this was outside our control. You may update your registration details via "My Profile" in your account. If someone else has used your account without authorisation, please notify us immediately.

12. Colours

We make every effort to display product colours accurately, but actual colours may vary depending on your device's display, and we cannot guarantee colour accuracy.

13. General

Any illegal or unenforceable provision of these Terms may be severed, and the remaining provisions will continue in force. Any indulgence or extension of time granted to you will not be treated as a waiver of our rights.
